Patent and Intellectual Property (IP) statistics in India

Patents and Intellectual Property (IP) are one of the strongest assets that a corporation can own. You can legally shield your idea,product, algorithm, process or invention from other copycats out there. You can also end up making huge amounts in terms of royalties (Qualcomm anyone?).

The significance of patents and IP is well recognized the world over.So, how does India fare when it comes to patents and IP ? What can be done to increase India’s IP wealth ?

Let us begin by taking a quick peek at the patent process in India.

The process of filing a patent / trademark in India falls under the jurisdiction of the Office of the Controller General of Patents, Designs and Trade Marks. The Patent department has four offices in Kolkata (head office), Chennai, Mumbai and Delhi. The Trade Marks Registry has its head office in Mumbai, with branches in Ahmedabad, Chennai, Delhi and Kolkata.

As per the latest available reports (2004 - 2005), there were 17446 patent applications and 78996 trade mark applications in India.

Of all the patent applications that originated in India, Maharashtra accounted for the maximum number of applications, followed by Delhi, Tamil Nadu, Andhra Pradesh and Gujarat.

Some of the leading patent applicants for last year were CSIR, Sun Pharma, Jubilant Organosys, Hewlett Packard, Matrix Laboratories, Biocon India.

In terms of where India stands as compared to the rest of the world, here’s the list (PDF) of countries ordered by the number of patent filings in 2004:

Japan, USA, Korea, China, EU, Germany, Canada, Australia, Russia, UK, Brazil, India, France, Mexico and Norway.

The number of patent filings in India increased by a whopping 365+ % between 1995 to 2004.

Even though the percentage increase seems pretty big, the actual number of patent filings is pretty small as compared to some of the rest of the countries. I think one of the main barriers in increasing the patent filings in India is increasing awareness amongst the people. People need to be educated about the patent filing process. The significance of IP and patents needs to be highlighted and the process of searching and applying for a patent should be made extremely easy.

    Very interesting article and being a lawyer specialising in Intellectual Property I feel that Indian businesses have just now realised how important is to protect their Intellctual Property. What is lacking is the knowledge which needs to be nourihed by training and workshops on Intellectual Property.
